Availability of Product:

6.1.

The availability of the Product under the offer to sell is subject to change without notice prior to the purchase of the Product by the Buyer. However, there may be circumstances where the Product may not be available to be delivered to the Buyer after the purchase transaction. In such an event, Natureallé may cancel or instruct to cancel such purchase transaction without any recourse to Buyer and without any liability to Natureallé. If Buyer's order is so cancelled, after the payment has been processed, the said amount will be reversed / remitted to the Buyer either to the bank account provided by the Buyer for such reversal, or to the payment instrument of the Buyer from which payment was made, or to any pre-paid payment instrument account of the Buyer. Natureallé shall have the sole discretion to determine the mode of reversal from the above options.

Pricing Information:

7.1.

The Selling Price of the Product is subject to change without notice prior to the purchase of the Product by the Buyer. The Selling Price is provided on the Website on 'as is' basis as provided by the Seller. Due to technical reasons there may be errors in Selling Price which may be corrected by the Seller at any time and any acceptance of offer of sale by the Buyer of the Products subject to such faulty Selling Price shall, subject to discretion of the Seller, not be a valid acceptance and such transaction can be avoided by the Seller.

Billing and Account Related Information:

Shipping and Delivery Policy:

16.1.

The User may place orders through the Platform and Natureallé shall dispatch the orders placed through booking on the Platform. Such orders shall be placed for delivery through the third-party service provider providing services in User’s city, state. All services on our platform shall be inclusive of a delivery charge as mentioned on the website and the generated final invoice. Delivery charges may vary depending upon the destination, volume of product, type of product, speed of delivery.

16.2.

We reserve the right to alter the delivery charges in accordance with the policies of the Logistics Partner. Delivery is considered complete as soon as the order is delivered to the customer. Customer can return the product only through the website.

16.3.

Shipping Timelines:

16.3.1.

Naturealle aims to provide estimated delivery timelines for each order on the website. These timelines are based on standard delivery conditions and are provided as a general guideline.

16.3.2.

The ordered items are dispatched within two business days. The order shall be tentatively delivered within 2-5 days of dispatch of the order, subject to the delivery address provided by the User.

16.3.3.

If the order is meant to be custom made, the Website will specify the turn-around time for producing and delivering the order.

16.3.4.

The delivery of orders may be delayed due to the high volume of orders. If there is a significant delay in the delivery time, the same shall be intimated to the User by phone or e-mail.

16.3.5.

Please note that delivery timelines may be subject to change due to external factors that are beyond control. Naturealle strives to deliver the customer orders promptly and efficiently. However, Naturealle acknowledges that certain external factors such as inclement weather conditions, natural disasters, transportation disruptions or other unforeseen circumstances may impact the delivery timelines. While we make every effort to minimize any delays caused by these external factors, Naturealle does not guarantee delivery within the initially estimated timeframe under such circumstances.

16.4.

Online Tracking:

16.4.1.

All the tracking details shall be sent by way of SMS to the Registered Mobile number, Emailed to the Registered Email Id provided by user on registering on our platform. User may have access to these details upon availing the services.

16.4.2.

All products placed online will be eligible for online tracking either on our platform or through the service provider’s platform who will provide the user with a tracking ID for order by which the user can track delivery on the Platform. Natureallé shall message the user, the tracking details after the order is dispatched. Users can also see the tracking details in the user order history panel in the account during login.

16.5.

Damaged Delivery:

16.5.1.

If the order has been damaged in transit, please contact Naturealle LLP with the order number via our mailed at care@Naturealle.com within 24 hours of receiving the Product. No claim for return/refund will be accepted post 24 hours of receiving the Product.

16.5.2.

In the event of the order being damaged, please save all the packaged materials and damaged goods before registering a claim. This will help us speed up the process of initiation of refunds.

16.5.3.

If no complaint is filed by the User regarding damage of the product within 24 hours, the order shall be treated as proper and the shipment from the Logistics Service Provider is successful. Following this 24 hour period, no liability shall be borne either by Natureallé or the Logistics Service Provider.

16.6.

Incorrect Delivery:

16.6.1.

If the delivery is incomplete or the delivery has not been undertaken, then the User may raise a complaint on our customer support email ID provided in the Terms of Service and Privacy Policy. We may investigate the issue and then proceed with a refund at the earliest in case of a discrepancy in providing services to user.

16.6.2.

In the unlikely event that you receive the wrong product, please get in touch with us within 24 hours by contacting us by email at care@Naturealle.com

16.7.

Shipping Rates and Cash on Delivery:

16.7.1.

Shipping Charges and Cash on Delivery will be calculated and displayed during the process of checkout. A flat shipping rate will be applied and we reserve the right to alter delivery charges, in the case of change in terms of delivery.

16.7.2.

In cases where the customer wants to change the mode of payment from COD to prepaid, a request can be sent via email to care@naturealle.com, within 24 hours of placing the order. This modification is only possible if the order is still in transit and has not yet been dispatched for delivery.

16.7.3.

After a request to modify the mode of payment is processed by our team, a link for payment will be sent to the customer's registered email and mobile number.

16.8.

Disclaimer:

16.8.1.

The User is responsible for paying any fees, taxes, octroi etc., incurred during or after shipping.

16.8.2.

Please bear in mind that minor variations on the colour and texture can occur from what is visible in the product pictures on the website due to the assorted technological and physical restrictions of the digital medium. The buyer acknowledges this risk when they agree to these terms and conditions.


17.

             Returns Policy:

We take care to procure and sell products of the best quality, in the best of conditions. We have delivery partners to ensure that all products reach you in the best of conditions.

17.1.

Upon your purchase of the product through our Platform, you do not have the right to place a return request or process a return request on general grounds. If the product so delivered,

17.1.1.

does not match the User’s order; or

17.1.2.

the size of the product is different than what was stated; or

17.1.3.

have expired; or

17.1.4.

have been damaged during transit.

the User may raise a request for the Return of the product by contacting the customer care of the Platform within 24 hours from the delivery of the product.

17.2.

We do not accept Returns for any other reasons apart from the scenarios mentioned above. The return process of the product can be restricted depending on the nature and category of the product and is subject to the following conditions.

17.2.1.

The customer should notify us of receipt of a Damaged / Defective product within a maximum time period of 24 hours after delivery. 

17.2.2.

Products should be returned in their original packaging along with the original price tags, labels and invoices.

17.3.

A return request shall be made only when the user has sufficient proofs for the product to be damaged on delivery or the product so delivered is incorrect.

17.4.

The Products that do not qualify for returns are:

17.4.1.

Products that have been altered or used; or

17.4.2.

Products whose serial number or bar code has been tampered with; or

17.4.3.

If the batch number of the Product does not match the batch number mentioned in the invoice;

17.5.

In such circumstances, before using the product, please get in touch with our Customer Service Team at care@naturealle.com within 24 hours of receiving the product. Our customer service team will guide you on the process for the same.


18.

Refund Policy:

18.1.

If the order is cancelled within 24 hours of being placed by the customer, the refund will be initiated within 3 business days.

18.2.

If there are multiple failed delivery attempts, the product(s) will be returned to the Seller, and the order will be cancelled and the order amount will be refunded after deducting shipping charges,tax and handling charges if applicable..

18.3.

The Refund shall be validated and initiated once the third-party seller inspects the shipment’s condition/packaging upon receipt of the product. The Refund shall be processed only once for each item. The Refund shall be initiated to the original mode of payment within 7 days of receiving the Product.

18.4.

Refunds are only possible in the following cases:

18.4.1.

Cancellation of an Order before being packed.

18.4.2.

Cases where:
a. Customers refused to collect the delivery
b. Customers weren't available during stipulated delivery attempts made by our logistic partner.
c. The delivery address was wrong/unreachable.

18.5.

Natureallé does not provide the exchange or general returns of their products delivered, and any return of the product has to be through the delivery personnel only.

18.6.

All Refund requests shall be made by the User by emailing to care@Naturealle.com, which will be the official mode of communication with the Platform. Natureallé shall waive all other means of communication made.

18.7.

All Refunds shall be made only on the basis and upon investigation by Natureallé’s Customer care on following such guidelines.


19.

Replacement Policy:

19.1.

Replacements shall be applicable only to certain items. For example:

19.1.1.

to fashion-related products. Replacements in the case of discrepancy in colour, quality, size etc., shall be processed subject to the availability of the particular product and at the sole discretion of Natureallé. In case the product cannot be replaced, the value of the product shall be refunded.

19.2.

The shipping charged for replacements shall be borne by the User.

19.3.

Refunds shall be processed only once per product.

19.4.

The original tags must be kept along with the returned items. This refund policy does not cover Products that have been purposefully damaged or mishandled. Items that are damaged and items without the original tags will be returned to the customer.

19.5.

There shall be no refunds, returns or exchanges for discounted/sale items.


20.

Cancellation of the Products Purchased:

We believe in helping our customers as far as possible, and has therefore a liberal cancellation policy. The User may cancel orders (where cancellation is permitted by Natureallé/ Vendor) within 24 hours of placing the order, and a refund shall be issued within three working days for prepaid orders. No request for cancellation will be entertained after 24 hours. Under any extenuating circumstance, please reach out to care@Naturealle.com.

20.1.

No cancellation fee shall be charged for any cancellation of order made within 24 hours of placement of order.

20.2.

Natureallé at its sole discretion may cancel any order(s):

20.2.1.

if it suspects a User has undertaken a fraudulent transaction, or if it suspects a User has undertaken a transaction which is not following the Terms of Use, or

20.2.2.

in case of unavailability of a service, or

20.2.3.

For any reason outside the control of Natureallé including causes for delivery related logistical difficulties.

20.2.4.

If Natureallé does not want to do business with the User

20.3.

We maintain a negative list of all fraudulent transactions and non-complying users and reserve the right to deny access to such users at any time or cancel any orders placed by them in future.

20.4.

Full cancellation of an order which means everything that can be cancelled without specifying any particular selection of product.

20.5.

Partial cancellation of an order which means a customer cancelling specific product(s), which may not be the entire order.

20.6.

In general, Naturealle does not allow partial cancellation of order(s). Once an order is placed it is processed as a whole. If the customer wishes to cancel an item, from their order, they will need to cancel the entire order and place a new one. We encourage the customers to review their orders carefully, before finalizing the purchase to avoid any inconvenience.

20.7.

In case a product becomes unavailable, Naturealle reserves the right to cancel that specific product from the customer’s order. In such cases, the customer will be notified via email and Naturealle will process a partial refund accordingly.

20.8.

Cancellation cannot be made once the products are dispatched.

20.9.

The customer can cancel an order partially, only under certain circumstances as mentioned below:

20.9.1.

The customer had ordered the wrong product by mistake.

20.9.2.

If any product(s) from the customer’s order becomes unavailable or out of stock before shipment.

20.9.3.

Naturealle reserves the right to assess the circumstances in which partial cancellation can be approved

20.9.4.

20.10.

Even if Naturealle cancels a partial order at its discretion, such partial cancellation will not be reflected in the customer’s account on the Platform. In such cases, an automated email will not be generated but Naturealle will notify the customer via a separate email regarding the partial cancellation at a later point in time.

20.11.

If the customer requests for a full cancellation and the same is processed, the refund amount will automatically be reflected in the customer’s account and the Customer will receive an email regarding the same.


21.

Limitation of Liability:

21.1.

In no case shall we, nor our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar identical damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

21.2.

Some states or jurisdictions do not allow the limitation or exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnity :

22.1.

You agree to indemnify, hold harmless and defend us, at your expense, against any and all third party claims, actions, proceedings, and suits brought against us or our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees and all relatable liabilities, damages, settlements, penalties, fines, costs or expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us or any of our officers, directors, employees, agents or affiliates, arising out of or relating to breach of these Terms of Service or the documents they incorporate by reference or your violation of any law.

Further, the User agrees to hold us harmless against any claims made by any third party due to, or arising out of, or in connection with:

User’s use of the Platform,

22.2.3.

User’s violation of any rights of another;

22.2.5.

User’s conduct in connection with the Platform.

22.3.

In no event we are liable to compensate the User or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable, and whether or not we had been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with the User’s use of or access to the Services or materials contained therein.


23.

Severability:

23.1.

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Cancellation of Termination:

24.1.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

24.2.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

24.3.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

24.4.

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Agreement and Governing Law:

25.1.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

25.2.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

25.4.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India and jurisdiction of Madras, Tamil Nadu.

The User and Natureallé agree to first enter into negotiations to amicably resolve any disputes or claims arising between them out of this agreement in good faith. In the event such negotiation fails, parties agree that such dispute or claim arising out of or relating to this Agreement shall be referred to Arbitration in accordance with the Arbitration and Conciliation Act of India, 1996. The Tribunal shall comprise of a sole arbitrator to be appointed by mutual consent. The seat of the arbitration shall be Chennai, Tamil Nadu, India and the arbitration shall be conducted in English. The parties shall mutually agree on a venue in Chennai and procedure for arbitration. The Parties shall share the costs of arbitration equally, however, this does not affect the right of the Arbitrator to award costs to any one Party.
